I am pleased to share that last week, the judge approved two of our applications in the tribunal proceedings, and we will soon receive much-needed disclosure about the fire safety surveys that were conducted.
As I mentioned in my previous email, our building has never had a remediation requirement, and it has always been considered fire-safe. However, after spending several hours investigating and speaking with individuals involved in our ESW1 survey, I have come across some concerning information.
The survey was conducted by Adam Kiziak of Tri-Fire Limited. Please the attached report, which rates The Maltings as B2 instead of B1 and our report commissioned.
Here are several critical points to consider:
1. Mr. Kiziak was suspended from the Institute of Fire Engineers (IFE) on August 21 this year. He has assessed fire risks since launching his business in 2020.2. The IFE confirmed that Mr. Kiziak “failed to maintain and work within professional competence.”3. He did not hold adequate professional indemnity (PI) insurance and failed to disclose significant exclusions in his policy.4. The IFE noted that he violated the organization’s principle of “accuracy and vigour.”

I have written to the Government today regarding this and demanding that we get another survey carried out free of charge, apologies if this will mean more people are required to come over and conduct invasive surveys.
We are also considering how to account for your increased mortgage payments due to our inability to remortgage at the best rates, along with any other expenses you may have incurred, as part of our claim against Urang and TTMC for Unjust Enrichment, which we have initiated (at the pre-action stage). An application is due to be issued to parties in the next few days.
A few members of the MCRA have stepped up to assist, and we are proud to announce the formation of a new RTM Company, which is being registered today. With a 51% majority, this strategic move will enable us to remove Urang, reclaim control of our building, and effectively reduce our service charges, given the issues left by TTMC.
