Dear Leaseholders, Members, and Co-Applicants,
We want to make all residents aware of a major development ahead of Monday’s Tribunal hearing.
At the heart of this lies the £42,000 per year TTMC paid to Elysian for landscaping and gardening in 2021 and 2022.
We have long argued that this spend was unreasonable and should be reimbursed or heavily reduced.
🚨 The Lie Exposed
In his sworn statement to the Tribunal, Joe Roberts (Divisional Head of Property Management at Urang) claimed that Elysian was a contractor “inherited” from L&Q (London & Quadrant).
This was false.
- L&Q’s solicitors have confirmed in writing that no such contract existed.
- Elysian’s own director confirmed it was Urang who introduced them to TTMC, having already worked on another Urang-managed site before Maltings Close.
👉 The truth: the £42,000 contract was set up by Urang and TTMC, not inherited from L&Q.
⚠️ Why This Matters
- Urang and TTMC attempted to mislead both residents and the Tribunal.
- They lied to cover up unreasonable charges.
- If they are willing to lie about this contract, what else are they misleading us about?
⚖️ Consequences for Urang and TTMC
If the Tribunal accepts our evidence:
- Their only witness testimony (from Joe Roberts) could be struck out as unreliable.
- They could face a costs order for unreasonable conduct.
- The matter could be referred to the County Court for contempt proceedings.
- Their credibility — in this and future cases — would be seriously damaged.
📅 What We’re Doing on Monday
At the start of the hearing, we will:
- Present written proof from L&Q and the statement from Elysian’s director.
- Apply to strike out Urang’s and TTMC’s witness evidence.
- Ask the Tribunal to proceed as if TTMC has provided no credible evidence.
- Reserve our right to seek costs for the additional work caused by their dishonesty.
🕑 Hearing Timetable
The Tribunal has scheduled 18–19 August to continue the case. But given:
- Multiple witnesses to cross-examine,
- Preliminary issues (including this dishonesty point),
- The length of earlier hearings (two full days just to cover insurance and Waking Watch)…
👉 It is highly unlikely the case will conclude by 19 August.
We will push for additional hearing days if needed, to ensure every witness is questioned and every piece of evidence is tested.
