We’ve secured official recognition, exposed mismanagement, triggered a government investigation — and Amar Lodhia even won a major case against Bellway and its consultants, forcing them to pay up. Now, you can get paid too (details below).

Here’s what every resident needs to know.

🏛️ 1. MCRA: Now a Legally Recognised Tenants’ Association

The Tribunal has formally recognised the Maltings Close Residents Association (MCRA) under Section 29 of the Landlord and Tenant Act 1985.

This means:

✅ We can legally object to contractor appointments

✅ Demand management and financial records

✅ Speak directly to Government and regulators

For the first time, residents — not the managing agent — hold the power.

⚖️ 2. You Are Protected – No One Faces Personal Liability

The ongoing case against Regen Facades is officially titled:

Amar Lodhia (on behalf of the Maltings Close Residents Association) v Regen Facades Ltd

No resident is named. No one is at risk.

The MCRA stands between you and every legal or financial burden — this protection is written into our constitution.

You cannot be pursued for these claims — ever.

⚠️ Misleading Letters from Regen’s Solicitors

Regen’s solicitors Howard Kennedy LLP recently sent a misleading letter directly to residents — ignoring procedure and the court.

We filed a formal complaint, and within 24 hours, their Senior Risk & Compliance Partner confirmed an internal investigation.

A barrister has been instructed to have the solicitor sanctioned or struck off.

To confirm:

  • The letter was sent in error by a junior staffer
  • It was procedurally improper
  • You can safely discard it

They did this because they’re rattled.

🏛️ Government Investigation Triggered

Our formal objection under Section 29 to Regen’s appointment has now triggered an official Government investigation.

The MHCLG remediation team is now reviewing Bellway and Regen’s conduct under the Developer Remediation Contract and will likely audit The Maltings, which was not previously on their audit list.

If Bellway allows Regen to begin work without the Association’s consent, they may be committing a criminal offence.

Regen blinked first. We stood our ground.

💣 3. TTMC: Insolvency Proceedings & Frozen Accounts Incoming

3Deling Laser Scanning Services Ltd has filed insolvency proceedings against Twelve Trees Management Company Ltd (TTMC).

Once published in the London Gazette, TTMC’s bank accounts will be frozen.

🚫 Do not pay any service charges to TTMC.

Judge Chakravarty ruled (13 August 2025) that TTMC cannot enforce service charges while the Tribunal case continues.

Now, with bankruptcy looming, TTMC’s days of mismanaging residents’ money are numbered.

💥 4. Adjudicator’s Decision: TTMC’s Incompetence Laid Bare

TTMC’s £42,000 debt exploded into a £78,000 disaster — paid from residents’ service charges.

The Adjudicator’s Decision (26 February 2025) found:

✅ A binding contract existed since 6 July 2022

✅ Urang Property Management (TTMC’s secretary) had full authority

✅ TTMC was not a qualifying leaseholder under the Building Safety Act 2022

❌ TTMC’s defence was baseless and misconceived

They fought a hopeless case, lost, and made residents pay the price — around £400 per flat wasted due to TTMC’s arrogance.

This confirms TTMC’s insolvency and proves it is unfit to manage residents’ funds.

🧱 5. Victory Against Bellway & Stantec – Compensation Now Available

On Friday, 10 October 2025, Amar Lodhia won in court against Bellway Homes and Stantec (Hydrock) for damages caused by intrusive surveys in December 2024.

If your flat suffered:

  • Holes drilled into walls or ceilings
  • Cracks around windows or pipework
  • Poorly patched or damaged areas

You could receive a payout of several thousand pounds.
